These conditions are concluded between:

and, on the other hand, people wishing to make a purchase via the website www.cidre-calvados-pommeau.fr
The customer acknowledges having read the Terms and Conditions below.

Article 1 - Applicable Law

The website www.cidre-calvados-pommeau.fr established in France is subject to French law.
Each purchase made by click confirmation, automatically implies your adherence to our general conditions of sale.
These general conditions of sale are governed by French law both for the rules of funds and for the rules of forms.

 

Article 2 - Legal Information

1. Minors and legal capacity: Ordinance No. 59-107 of 7 January 1959 and Law No. 74-631 of 5 July 1974 prohibit the sale and supply of alcoholic beverages to minors and assimilated persons. Therefore, when completing your order, you acknowledge that you have the legal capacity to enter into this contract.

2. C.N.I.L. Article 3 - Price

Prices quoted in euros are deemed net, excluding postage. The prices can be modified at any time without notice, the articles being invoiced on the basis of the tariff existing on the day of the recording of the order.
Orders are payable in euros only, by credit card, and this before the shipment of the order.

 

Article 4 - Secure Order

In order to optimize the security of Internet transactions, a Paypal usage system is offered to customers and allows you to encrypt all the data relating to your orders, so that the information you provide is protected during transmission. (your name, address and card number)
In addition, the means and services cryptology used to secure transactions have been the subject of a declaration or an authorization under the legislation in force.

 

Article 5 - Processing time of your order

Your orders are processed as quickly as possible during business days.

 

Article 6 - Delivery

1. Conditions: The ordered products are delivered in parcel by the carrier to the address indicated by the customer. The Customer is in particular to check the condition of the packaging and its contents, because the signature of the delivery receipt will carry acceptance of the package. The customer is required to inform within 48 hours after receipt of the package GAEC Leveille any damage caused by transport.

2. Deadlines: We deliver only in mainland France. The average delivery time in standard service is 72 hours, from the receipt of the order (Monday to Saturday, order placed before 13:00). From 01/12 to 31/01, allow a maximum of 8 days delivery time due to the great activity of the holiday season. Except in cases of force majeure, delivery times will, within the limits of available stocks, those indicated above, excluding Sundays and French holidays. All orders placed will be processed from Monday to Saturday until 13:00, excluding French holidays. The GAEC Leveille agrees to do its best to have your shipment delivered in accordance with our usual delivery times, however, if we were not able to give you satisfaction, we specify that under no circumstances the reimbursement of product may be required and that only the delivery service may, subject to the reservations in paragraphs 6.3 and 6.4, be refunded within 30 days.

3. Circumstances beyond our control: We can not be held responsible for any loss, damage, error or non-delivery of a shipment as long as circumstances beyond our control are established. "Circumstances beyond our control" include: fortuitous events or force majeure. any defects or particularities related to the nature of the shipment. any act, failure or negligence of any third party.

4. Indirect damages: In the event of non-respect of our commitments and whatever the cause, the GAEC Leveille will be held only with the refunding of the delivery service under the reservations stated above and in no case of the indirect damages that the customer would come to invoke. These indirect damages and losses include any loss of income, profits, interest or markets and any loss related to the inability to use all or part of the shipment.

5. Break in the course of the shipment: The customer must open and check the package at the moment the carrier gives it to him, because if it did not do at that moment, no claim on the possible breakage or shock of the product can not be retained.
If a package arrives at the damaged recipient, the recipient must refuse the package, the carrier will then inform the GAEC Leveille. Upon receipt of this information, the GAEC Leveille agrees to return to the recipient immediately an identical package, but in no case the customer may require the refund of the product and the delivery package.


6. Product Availability: All products offered are available in stock. Only the company is forced to do only two days of grouped mailings per week (Wednesday and Saturday), so even if your product is in stock, you can exceed 72h delivery, being subject to the condition of the day sending. If the product you have selected can not be replenished, we will inform you of the situation by mail, e-mail or phone

7. Degradation of the quality of the products: Under no circumstances can the GAEC Leveille be held responsible for any deterioration in the quality of the products and their packaging caused by transport.

8. Delivery address: If the parcel is returned to GAEC Leveille because of a false address or incomplete, we are committed to contact our client to inform him of the situation and request additional information on the address or a new shipping address. The costs of this redirection will be borne by the customer and the starting point of the new delivery time will be linked to the receipt of new information about the address.

9 Reception of products: the GAEC Leveille advises you to let rest for 24 hours the products that you have received, and in particular the effervescent alcohols, in order to preserve their original aromas and to avoid a violent expulsion of the stopper.

 

Article 6 - Cancellation

Any request for cancellation of an order must be made, before shipping the products, to be taken into consideration. The minimum time to notify us is 24 hours before the date of departure of packages. This cancellation must be done by email or phone.


Article 7 - Retraction

You have a period of 7 days after receipt of the package to return it to us, in its original packaging, and obtain a refund, excluding return costs.

To process your requests, we kindly ask you to specify your name and surname, address, date and order number and your customer reference. We will not be able to take into account any incomplete request.

Article 8 - Liability

The liability of the GAEC Leveille can not be engaged in case of force majeure and especially in case of total or partial strike, flood, fire or other natural disasters and in general any event does not allow the proper execution of the order.

Article 9 - Electronic Signature

The "OK" associated with the authentication, non-repudiation and the protection of all messages is an electronic signature. This electronic signature has value, between the parties, of a handwritten signature.

Article 10 - Evidence

The computerized registers, kept in the computer systems of Made in Calvados under reasonable conditions of safety, will be considered as proof of communications, orders and payments between the parties.

Article 11 - Dispute Resolution

All the contractual provisions defined above are governed by French law. Our Customer Service is at your disposal for the amicable settlement of any dispute.
